Hojoki operates the internet platform CatchApp under the domain getcatchapp.com. The site provides users the opportunity to inform themselves about Hojoki’s service CatchApp, register for a cost-free membership, as well as sign up for a fee-based Premium Service membership. Inside the membership platform, users are able to create so-called “lists” and connect so-called “apps” from third-parties (for example, Dropbox) to their account.

2. Collecting, processing, and use of your personal data

We collect, process, and use your personal data only if it is allowed or appointed by law, or if you have given your consent to do so.

3. Collecting, processing, and use of your personal data for the use of the website and the use of both the cost-free membership and fee-based Premium Service Plan

a. Automatic collecting and storing of data when using the website

For technical reasons, certain data is always passed on to us from your computer as the communication takes place on the internet. This includes the date and time you visited our website, your browser type, the browser settings, the operating system, the previous website you visited and the quantity of data transmitted.
This information will be only stored to use in the case of an error and will be deleted after seven (7) days. This information is usually not personal data. Furthermore, your computer also transfers your IP-Address to us, which in individual cases could be personal-related. The above-mentioned data is only used for internal system-related purposes.

b. Collecting, processing, and use of personal data when registering for and using the cost-free membership

You are required to register for the use of cost-free membership’s services from our website. In the context of the cost-free registration, it is necessary that you provide various personal data which we will store and use. In doing so, we only require you provide such information in order for you to be able to take advantage of the cost-free membership’s services.

In the registration process, we collect and use your email address and ask you to choose and create a password. Instead of specifying a self-chosen password, there is also the opportunity to provide your Facebook or Google Profile information for authentication purposes. Additionally, you can also provide us with your name and upload a picture to your membership profile.

We primarily use the above-named data to authenticate you as the legitimate user of the cost-free membership.

Within the cost-free membership, when you create so-called “lists” and connect so-called “apps” from third-parties(i.e. Dropbox), it is also required that you provide personal data which we will store and use.

In doing so, we only require you provide such information in order for you to be able to take advantage of the cost-free membership’s services. In the process, we collect and use the name or the url, the respective linked account (the “OAuth”), and the respective username and password from the third-party apps which you connect to our website and want to use in your lists (in the cost-free membership).

We use the above-named data in order to make it possible for users to use their chosen third-party apps with our website and integrate them into the lists they create. Additionally, we use the above-mentioned data to give you regular updates regarding your personal statistics of your use in your account. We send the updates to your email as a so-called, “Daily Catch-Up” and “Weekly Summary”.

Furthermore, we (automatically) store certain activities during your use of the cost-free membership. This includes the user-ID, your login date and time, your browser type, the browser settings, the operating system, the type and number of connected third-party apps, and the type and number of lists set up.

More particularly, for the purpose of managing our product development and quality assurance, we create internal statistics of the usage intensity of our website services.

We also store so-called meta data of your activities from the third party apps that you connect to your lists (activities in the third-party apps). In doing so, we do not store the relevant data and/or objects from the third-party apps itself, but a referencing link (for example, a Google document or a file uploaded to the Dropbox “app”).

We use the above-mentioned data to create a so-called “dashboard” and “activity feed” for the user which provides them with an overview of their activities of the connected apps.

Unless you give us permission to continue to store and use your data, we delete the above-mentioned information as soon as you deactivate your cost-free registration of your website membership.

c. Collecting, storing, and use of personal data in the context of ordering and using the website’s fee-based Premium Service Plan

You are required to provide various information, including personal data, during the registration process for the fee-based Premium Service Plan.
We will store and use this data. In doing so, we only require you provide such personal data in order for you to be able to take advantage of the fee-based, Premium Service Plan. We collect and use your name, a billing address, as well as your billing information (for example, bank or credit card information).

We only use the above-named data for the purposes of billing you for your use of the fee-based premium services and to make your use of these services possible.

Furthermore, we (automatically) store certain activities during the use of the fee-based Premium Service Plan. In this respect, we reference the above remarks under section 3b.

We collect, process and use your personal data only if it is allowed or appointed by law, or if you have given your consent.

Unless you have given us consent to store and use your data for purposes other than the registration, use, and billing of the fee-based Premium Service Plan, we will delete the above-mentioned data as soon as mutual claims have been met and discontinued. Please note that under certain circumstances involving legal reasons, we may be required to further store your data. In this case, we will delete your data as soon as we are no longer obligated to store it.

d. Further collecting, processing and use of your personal data from the website

Our services include providing our website’s visitors the opportunity to submit a digital contact form with any questions and problems, etc. which they may have.

In the context of the contact form, you are required to submit various information, including personal data which we will store and use. In doing so, we only require you provide such personal data in order for us to be able to process your inquiry. We collect and use your email address as well as your pictures and videos, etc. if you have transmitted such files.

We only use the above named data to process your inquiry. Unless you have given us your consent to store and use your data for purposes other than processing the inquiry you submitted, the above-mentioned data will be deleted as soon as your inquiry has been processed. Our employees who maintain the appropriate privileges, and those working on behalf of Hojoki’s external IT and payment service providers, are able to view the above named personal data. Please note that based on the current state of technology, absolute security of data transfer on the internet can not be guaranteed. The user is responsible for the security of the data they transfer through the internet.

4. Additional collecting and processing of personal data and transmission to third-parties

In some cases, we may transfer personal data to a third party. This is only if it is required or permitted by law, or if you have given your consent.

5. Data processing outside of the the European Union (“EU”) and the European Economic Area (“EEA”)

As a basic principle, the processing of data takes place at a data center within the EU or EEA. Additionally, we process your data in a US-American data center or by a US American service provider. Hojoki has put the necessary measures in place to ensure that the U.S. data centers/service provider have an adequate level of data protection to protect personal data of customers and visitors of the Hojoki website.

6. Cookies

We use so-called “cookies” for authentication purposes. Cookies are small text files that are stored to your hard drive by the web server. In these files, the so-called “Session ID” and the address of the internet site is stored, which you can access from our server before you login.
